A routing choice (e.g. between free trade ports vs. general ports) can have an impact that’s greater than most companies realize; it will have a direct bearing on duty outflows, storage and warehousing flexibility, working capital, the ability to comply with legal requirements, and how quickly a company’s goods will be available to reach their end customer. In effect, the ultimate impact of these considerations boil down to how much control the importer wishes to maintain over their own supply chain. The following example describes what we have seen when implementing a routing decision.
Free Trade Ports vs General Ports: What General Ports Offer — And Where They Stop
India’s major general ports — JNPT (Nhava Sheva), Mundra, Chennai, Vizag — handle the overwhelming majority of the country’s container traffic. Mundra and JNPT alone account for over 60% of India’s container load. They are well-connected, established, and operationally mature. For straightforward imports with a clear domestic buyer and immediate clearance intent, a general port works adequately.
Once a vessel reaches an Indian port, the carrier files an Import General Manifest listing all consignments. Within 24 hours of arrival, importers or their CHAs must file a Bill of Entry via ICEGATE. Customs then verifies the declared goods, HS codes, and valuation before issuing an Out-of-Charge order — formal permission for cargo release.
On paper, this looks clean. In practice, it carries significant risk exposure.
Any delay in customs clearance results in demurrage or detention charges — fees charged by the port or shipping line for holding containers beyond the free period. These delays not only disrupt supply chain schedules but also increase costs substantially.
The 2025 regulatory environment has added further complexity. Recent enforcement of Extended Producer Responsibility compliance has caught many importers off guard. Unclear environmental mandates, inconsistent interpretations, and discretionary enforcement are turning routine imports into month-long battles.
The industry has also been facing significant challenges with raw material storage due to inadequate facilities at some ports. Not all ports have climate-controlled storage, posing risk for sensitive components like semiconductors, circuit boards, and lithium-ion batteries.
The larger structural limitation of general ports is this: the moment goods arrive and are declared, the duty clock starts. There is no pause, no flexibility, and no room to wait for market conditions or buyer readiness. Capital gets locked immediately.
Free Trade Ports vs General Ports: What the FTWZ Model Actually Changes
In India, Free Trade Warehousing Zones — also known as FTWZs — are completely different from free trade ports in terms of their function and logic. FTWZs are essentially warehousing facilities within the physical borders of India, but they’re treated as being outside of India’s customs territory when it comes to the management of goods that are stored there. This simple difference has a huge impact commercially. For example, the most immediate effect is that customs duties are deferred until the goods stored in an FTWZ are moved into the domestic tariff area for purposes of being sold in India. Thus, duties paid at the moment of storage will not be collected until the goods are actually sold, and thus, this deferred payment improves working capital by getting funds into your account on day one. The other major benefit of FTWZs is that when there is a clearance of goods from an FTWZ to the domestic tariff area, you only pay customs duties on the quantities being cleared and not on the entire quantity of goods being stored. This provides you as an importer with even finer control over your total duty liability, thus making FTWZs of particular interest to you if you’re a high-volume importer who is continually trying to manage changing domestic demand. In comparison, as it relates to a full port or free trade ports, when there is a full duty assessment at the time of clearance, regardless of when sold. A large difference in cash flow is experienced throughout the entire financial year between FTWZs and the two port types.
Free Trade Ports vs General Ports: The Permanent Establishment Advantage
Routing cargo via free trade ports also has a unique benefit for external parties as FTWZs allow overseas companies to store imported products without paying the duty for an extended time without requiring an obligation to establish a permanent establishment (PE) in India or even having identified a buyer before the physical arrival of goods. An overseas principal can import products into an FTWZ, store them there and then sell them into the Indian market without the need to establish a local legal entity or appoint an importer of record in India, and without the burden of fulfilling the full compliance requirements of having a local presence. From the buyer’s perspective in India purchasing product from an FTWZ, the customs process is exactly the same as if purchasing directly from a supplier in another country. Thus, both buyers and sellers have clean transactions through the free trade route.
General Ports do not provide an equivalent alternative to the above-mentioned process. Different from being an overseas entity that imports goods via a general port, to import goods through a general port, a foreign entity must have a registered Indian company to electronically file a bill of entry at the port of entry along with a permanent business address. The FTWZs eliminate all of this administrative burden for new companies trying to understand the Indian marketplace or manage distribution throughout all of India from one regional distribution centre.
Free Trade Ports vs General Ports: Licensing, Compliance, and Regulatory Exposure
When importing products into India via a conventional seaport, they are subject to a full array of domestic product regulations (BIS registration, FSSAI clearance, license(s) for controlled drugs and environmental compliance) as soon as they enter the country, and the unpredictability associated with the duration of enforcement is increasing.
Free Trade Warehousing Zones (FTWZ) do not require BIS, FSSAI and drug licenses for products that are stored in these zones. Thus, businesses engaged in importing electronics, pharmaceuticals, food and beverages, chemicals and/or consumer products can benefit from shortened import processing times when importing products with licensing requirements that can take weeks or months.
At a conventional seaport, if any regulatory issues arise at the time of cargo clearance, demurrage will begin accumulating while the importer rectifies the issue. Conversely, when imported cargo is stored in a free trade warehousing zone, the cargo is under secure storage until such time as all compliance issues have been resolved; however, there will not be a port storage clock running against the importer during this time.
Free Trade Ports vs General Ports: Value-Added Operations and Re-Export Flexibility
Free trade ports also serve as active storage facilities by allowing various permitted activities. Within an FTWZ (Free Trade Warehousing Zone), you can do things such as packing, labelling, palletising, consolidating, conducting a quality check on the goods, kitting and sorting of products, and testing. Goods can be prepared for sale, repackaged and/or checked while they are still in the zone prior to being cleared for domestic consumption or being re-exported, and will not have any duties applied to them.
For companies importing goods from multiple origins in Southeast Asia, China, and Europe, consolidation of goods within a free trade port allows for one invoice to be issued to one buyer (Indian). This consolidation of goods from multiple origins is not available at a normal port.
An additional benefit of free trade ports is the flexibility that exists for exporters when it comes to re-exporting products. In a free trade zone, the products can be re-exported without having to pay duties and can be sold using foreign currency; whereas at a normal port, after goods have been cleared for home consumption, re-exporting the goods requires a different set of documentation to be provided, refund application(s) to be submitted and additional procedures to be followed. The FTWZ model provides exporters with the option of awaiting domestic clearance before committing to that process.
Free Trade Ports vs General Ports: Clearance Speed and Supply Chain Predictability
General ports continue to encounter actual dwell-time problems despite India’s national customs portal and faceless assessment systems digitizing operations. For well-documented shipments, average time from arrival to clearance is between 1– 3 days; however, flagged shipments for examination usually take 5–15 days to clear. The port has three primary factors causing unpredictability in transit times that supply chains depend heavily on (congestion at the port, risk-based flagging of shipments and queues waiting for examination).
Customs clearances in Free Trade & Warehousing Zones are generally completed within 24 to 48 hours of receipt of shipment. The dedicated, on-site, customs environment (with resident customs officers, published protocols for the zone and a single operational interface) eliminates the lack of coordination that is commonplace with general port clearances.
OSV FTWZ: Free Trade Ports Access Across India’s Most Active Trade Corridors
The OSV FTWZ network serves importers from all eight regions: Kolkata, Chennai, Hyderabad, Mumbai, Mundra, Noida, Kochi, and Kandla. These locations encompass each region’s major import corridors, both east to west and north to south. Mumbai and Kochi serve as the geographic endpoints of the western and southern Indian coastlines, respectively, while Chennai and Hyderabad support southern India as industrial and supply chain distribution centers, respectively. OSV FTWZ at Kolkata is also strategically located to serve as the primary eastern gateway for importers who trade with countries in South East Asia (including Bangladesh and Myanmar) and other countries along the Bay of Bengal. Kandla is an older port facility that has a substantial amount of bulk and commodity-in-transit freight capacity and provides a direct connection between northern and southern India via the western coastline.

India’s import policy is clearly becoming a zone-based management system that provides structure. The government’s new regulations from February, 2025 streamline clearance at authorised importer premises rather than congesting general ports. This indicates that port bottlenecks are not just operational inconveniences, but recognised policy problems as well. FTWZs have been built around this concept since the introduction of the SEZ Act of 2005; however, what can no longer be ignored when considering routing options for foreign importers is the sheer magnitude, complexity and compliance sensitivity of trade moving through India in 2025-26 — making the case for free trade ports undeniable. To foreign importers considering where to route their cargo, there is a clear choice being made between free trade ports and general ports based on either operational control or operational dependence.
